Introduction

The Student Union membership program is governed by the following terms and conditions. It is your responsibility to read and understand them. If there is any conflict between what is set out in this booklet and anything a Member has been told by Student Union staff or its agents, the terms of this booklet shall prevail.

Every Member is responsible for remaining aware of the Terms and Conditions. Every effort has been made to ensure the information provided to Members in relation to the Student Union membership program is correct but the Student Union is in no way responsible or liable for any inaccuracy in the information provided to Members concerning the membership program.

These Terms and Conditions are effective as at the date of publication (October 2007) and the Student Union reserves the right to amend the Terms and Conditions of the membership program from time to time.

The Student Union shall use all reasonable endeavours to advise Members of any such changes, but shall not be liable in any way for any failure to do so.

Definitions

  • ‘The Student Union’: Comprises MU Student Union Ltd ACN No. 107 286 706 and University of Melbourne Student Union ABN 78 125 531 707
  • ‘Member’: a person who is a current member
  • ‘Benefits’: any of the facilities, services or arrangements offered or available to the Member during the period of membership
  • ‘Goods’: All goods provided by the Student Union
  • ‘Services’: All services provided by the Student Union
  • ‘Terms and Conditions’: these Terms and Conditions as amended from time to time
  • ‘Sticker’: The Student Union Member sticker to be affixed to a University of Melbourne student or staff ID card

Use of your membership

The University of Melbourne student ID card with a current Student Union Member sticker affixed is required to be presented by the member to access all or any services or departments of the Student Union as part of the membership benefit package.

It is the sole responsibility of the member to ensure they have their student ID card with a current Student Union Member sticker affixed at all times in order to access services and/or benefits. ID cards may need to be scanned at some services.

Student Union membership is valid only for the member and is not transferable under any circumstances.

The member’s Student Union membership is valid only for the period indicated on the Student Union Member sticker affixed to their student ID card.

The Student Union reserves the right to require the member to produce their student ID card with a current Student Union Member sticker affixed at any time while utilising services or obtaining benefits.

In the event of loss or theft of a student ID card it is the responsibility of the member to inform the Student Union in writing.

The Student Union will not be liable for misuse of a lost or stolen student ID card.

In the case of misused, lost or stolen student ID cards a replacement sticker fee of $5 (GST inclusive) will be charged by the Student Union. This is in addition to any charges the University of Melbourne may require for replacing the student ID card.

The replacement sticker fee will be waived upon request under the following circumstances:

  • Stolen card: police report or reference number required
  • Faulty card: Card has an inoperable bar code.

The member shall be responsible for advising the Student Union of any change of name or address.

By affixing the Student Union Member sticker the member agrees to be bound by these terms and conditions.

General:

This agreement is personal to the Member which shall not assign its rights or delegate its performance hereunder.

If the membership fee continues to remain outstanding 14 days, the Member’s account will be forwarded to the Student Union’s debt recovery agency for further action. The Student Union shall then be entitled to charge the Member for all expenses incurred in relation to the collection of any fees and charges which shall include but not be limited to the debt collection agency’s fees, legal costs and disbursements.

All membership fees are non-refundable and non-transferable except as specified below:

  • A Member’s visa expires
  • A Member transfers to another institution (timeframe)

Should a Member cancel his or her membership in accordance with the above, upon cancellation the Member shall be immediately liable for all amounts for goods or services outstanding.

The Student Union reserves the right in its absolute discretion to withdraw, cancel, deny access to or in any way change any of the benefits advertised or offered at any time and the Student Union will not be liable for any loss or damage suffered by the Member resulting from such withdrawal, cancellation or change.

The Student Union reserves the right to suspend or terminate a Member’s membership for violation of its rules and regulations or for conduct deemed detrimental to the welfare of the Student Union.

The Student Union will only use the information provided to it from the Member in accordance with the its Privacy Policy.

In the discharge of its duties the Student Union shall comply with all reasonable resolutions, regulations and directions that may lawfully be made from time to time as to the nature and scope of the service to be provided

Nothing in the above clause shall effect the Student Union’s right to exercise its own judgment and to utilize its skills as it considers appropriate in order to achieve compliance with the said resolutions, regulations and directions or otherwise with its obligations under this agreement. Many of the products and services offered for sale in the Union House are products and services of third parties, being parties other than the Student Union. Third party products and services are not provided by the Student Union and the Student Union shall not be held liable for any loss or damage in relation to the products or services of third parties.

All disputes relating to or arising out of this agreement:

  1. Shall be governed by the law of Victoria
  2. Shall be resolved in the Victorian court with the appropriate jurisdiction

Direct Debit Terms and Conditions

  1. The monthly price is available only via an automated direct debit from a credit card or Australian bank account.
  2. Payments are processed on the fifteenth of each month.
  3. There is a three month minimum for direct debit membership
  4. If you cancel your membership before three months have elapsed you will be charged the difference upon cancellation
  5. Your payments will continue until you inform us you wish to resign your membership
    1. It is your responsibility to inform us of any changes to your account details or enrolment
    2. Direct debit cancelation forms are available at the Information Centre (ground floor, Union House) and online at union.unimelb.edu.au/membership/how-to-join
    3. Your direct debit membership will automatically rollover each year
    4. You must cancel your membership by the tenth of the month to avoid that month’s payment
